Acceptance of Terms

By accessing or using the services provided by AspiraTrade Medical Tourism ("AspiraTrade," "we," "us," or "our"), including this website and any coordination of medical, travel, or accommodation services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you must not use our services.

Description of Service (Facilitator Role)

AspiraTrade operates strictly as a medical tourism facilitator and coordinator.

2.1. Nature of Service:

We coordinate, organize, and facilitate access to healthcare services, accredited hospitals (JCI & NABH), surgeons, travel, and accommodation in India. Our services include providing preliminary consultation, cost estimates, itinerary planning, visa assistance, and logistical support.

2.2. No Medical Advice:

AspiraTrade does not provide medical advice, diagnosis, or treatment. Any general information provided on our website (including procedure descriptions, pricing estimates, and testimonials) is for informational purposes only. The formation of a doctor-patient relationship and all medical decisions occur directly between the patient and the treating healthcare provider (the hospital and/or surgeon).

User Obligations and Accuracy of Information

3.1. Provision of Accurate Data:

The User is solely responsible for providing complete, accurate, and truthful medical records, diagnostic reports, passport information, and contact details to AspiraTrade. Any delays, complications, or additional costs arising from incomplete or misleading information will be the sole responsibility of the User.

3.2. Compliance:

The User must comply with all international and Indian laws, including requirements for medical visas, passport validity, and travel regulations. AspiraTrade provides assistance but is not responsible for the approval or denial of visas or entry into India.

3.3. Financial Responsibility:

The User is responsible for the full cost of the medical package, including any deposits, surgical fees, accommodation fees, and any unforeseen medical expenses arising from complications or changes in the treatment plan.

Fees, Payment, and Cancellation Policy

4.1. Pricing Estimates:

All prices quoted by AspiraTrade are initial estimates based on the diagnostic reports provided. The final treatment cost is determined by the hospital and treating surgeon after a full clinical assessment upon arrival.

4.2. Deposit:

A non-refundable deposit (amount specified in the personalized quote) is required to formally begin the coordination process (e.g., booking surgeon time, hospital slots, visa invitation letters).

4.3. Cancellation:

If the User cancels the trip after paying the deposit, the deposit is non-refundable. Additional cancellation penalties may apply based on the specific third-party policies (e.g., non-refundable airline tickets, hotel pre-payments). If the treating surgeon determines the User is medically unfit for the procedure upon arrival, AspiraTrade will refund any amounts paid to the hospital, minus the non-refundable coordination fee and any third-party penalties incurred.

Limitation of Liability

The User acknowledges and agrees that AspiraTrade is not a party to the medical treatment contract. AspiraTrade assumes no responsibility for the actions, results, complications, negligence, or malpractice of any hospital, surgeon, nurse, or other medical professional involved in the User's treatment.

Third-Party Services:

We are not liable for any failures, delays, or issues arising from airlines, hotels, or other third-party providers. All claims related to medical treatment must be directed exclusively to the treating hospital and physician.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

Privacy Policy

Your use of our services is also governed by our Privacy Policy, which details how we collect, use, and protect your personal and sensitive medical data. You consent to the terms of the Privacy Policy by using our services.
